Arizona Supreme Court Sides With Southern Arizona Home Builders in Suit Against Marana
In 2013, the Town of Marana purchased a water reclamation facility. Following the acquisition, the Town did a significant expansion of the facility. The cost of the acquisition and expansion was assessed to new development in the form of development impact fees. These fees are paid by home builders at the time a building permit is issued by the town.
